Administrative Closure Pending (I-130 Form) Approval for LPR Relative Sponsor
Matter of S-G-V, A# 649 (IJ March 14 2024) (Laredo, TX) (IJ Caudillo) In this case the DHS opposed to administratively close proceedings because the lead respondent, a Mexican woman was married to a Legal Permanent Resident. The government argued that, because there won't be an immediate visa available, administrative closure was not appropriate in the instant case. Our office filed the I-130 Forms for the mother and the rider respondents their two children with the USCIS. The IJ rejected the government position, made a preliminary determination that the marriage was a bona fide marriage, because the children were born before the marriage happened; therefore, the respondents rebutted the presumption of fraud under INA sec. 204(c), and GRANTED administrative closure to allow the family petition process (Form I-130) continue at USCIS.
